  • Delhi high court also directed Karti Chidambaram to surrender his passport to the ED and cooperate with the investigation

The Delhi High Court on Friday granted interim relief to Karti Chidambaram, son of Congress leader P Chidambaram, from arrest by the Enforcement Directorate in connection with the INX Media money laundering case.

The apex court had on February 23 refused to stay the summons issued by the ED against Karti Chidambaram - who is presently in CBI custody in the INX Media case.

At the outset, the Sibal said the ED case was of "political vendetta" and "witch hunting" and so far, Karti has not been given the ECIR copy to know the details of the case. P Chidambaram was present during the proceedings, both in the high court and the trial court, while his wife Nalini, also a senior advocate, was there in the trial court.

CBI has been successful in getting custody of Karti Chidambaram till March 12 2018 from a special court today.

Karti Chidambaram was arrested by the CBI at Chennai airport in connection with alleged bribery at INX Media on 28 February, and was sent to a day's custody by a special CBI court.

A bench headed by Chief Justice Dipak Misra passed the order on Karti's plea despite strong opposition from Enforcement Directorate that the plea should not be allowed to be withdrawn but heard and disposed of. It is not witch-hunting. He said Karti needed to be confronted with the documents. "Is it a fair procedure of investigation?"

Karti has been granted the Interim Protection from the Delhi High court after being denied yesterday.

He also sought striking down the presumption codified in Section 24 of the PMLA which says that when a person is accused of having committed an offence under section 3 (money laundering), the burden of proving that proceeds of crime are untainted property shall be on the accused, as unconstitutional.

The court also directed the investigating officer to get Karti medically examined as per the rules every 24 hours during the custody. The court said that the agency has been able to give "sufficient ground and justified reason" to uphold its contention.

"Don't go into all this", the bench said. For one year, you (CBI) couldn't find the firm's registered office which is your main accused.

The Enforcement Directorate had filed a case against him previous year alleging fraud in the grant of Foreign Investment Promotion Board (FIPB) clearance to INX Media for receiving foreign investment of over Rs 300 crore in 2007 when P Chidambaram was the union finance minister.
