Serial Subject Adnan Syed Deserving Of New Trial, Says Appeals Court

"Trial counsel's deficient performance prejudiced Syed's defense... because, but for trial counsel's failure to investigate [McClain], there is a reasonably probability that McClain's alibi testimony would have raised a reasonable doubt in the mind of at least one juror about Syed's involvement [in] Hae's murder, and thus 'the result of the proceedings would have been different.'"

Adnan Syed, whose murder conviction was the subject of the popular "Serial" podcast, has been granted a new trial.

Chapman said she was in the library next to their high school when she saw Syed at the time Lee was said to have been murdered. A retired Baltimore judge issued a ruling in June 2016 granting Syed a new trial on the grounds that he received ineffective counsel in 2000 from a defense attorney who failed to cross-examine a state cell expert witness on key evidence. Syed's attorneys then filed a separate conditional appeal, asking the court to look at the alibi issue.

Judge Martin Welch, who overturned the conviction in 2016 in Baltimore City Court, agreed with that assessment, saying that Syed's first attorney "fell below the standard of reasonable professional judgment". The ruling can still be appealed to the Court of Appeals, according to ABC News.

In 2000, Syed was convicted for the first-degree murder of Lee, his ex-girlfriend.

Syed's lawyer, C. Justin Brown, said he is ready for a new trial.

Syed's story was widely publicized in the 2014 "Serial" podcast, which cast doubt on his guilt.

Brown said he is pleased by the ruling and said he hopes the state won't appeal it. In a statement to the Sun, the office of Maryland Attorney General Brian Frosh said it was "currently reviewing today's decision to determine next steps". Further information regarding Syed's retrial, including a court date, has not been released.
