Does Trump have the power to post-humously pardon Johnson?

Trump, spurred by a phone call from Sylvester Stallone, tweeted Saturday that he's thinking about posthumously pardoning the trailblazing fighter.

It reads: "Sylvester Stallone called me with the story of heavyweight boxing champion Jack Johnson". Now, the President tweeted to say that after speaking to "The Expendables" star on the phone and learning about the life of Jack Johnson, he is "considering" giving him a "full pardon". "Others've looked at this on time, many presumed it would be performed, but yes, I am considering that a Full Pardon!"

In 1913, Johnson was convicted of taking his white girlfriend across state lines. After falling short in their first attempt at building a case against Johnson, assistant U.S. District Attorney Harry A. Parkin asked the Justice Department's Bureau of Investigation to "secure evidence [of] illegal transportation by Johnson of any other women for an immoral objective". John McCain, R-Ariz., and former Senate Majority Leader Harry Reid, D-Nev., have been pushing Johnson's case for years.

In 1908, Johnson was the first African American to win the heavyweight championship.

President Trump said he is considering a pardon for boxer Jack Johnson. However, he skipped bail with one of the women involved, Lucie Cameron, and traveled to Montreal, Mexico, Europe and South America for years, the Post added.

So far, Trump has pardoned three people during his presidency, including former Arizona sheriff Joe Arpaio and, most recently, Lewis "Scooter" Libby, a chief of staff to former Vice President Dick Cheney. He died in 1946 in an auto crash.

In 2017, the Telegraph said he was the third-best boxer of all-time. In 1999, President Bill Clinton pardoned Henry O. Flipper, the first African-American officer to graduate from West Point in 1877, after being unjustly accused of embezzlement.

"Despite this resolution passing both chambers of Congress several times in recent years, no pardon has been issued to date", McCain said in a statement at the time.

Trump isn't the first president to be asked to give Johnson a posthumous pardon.
