With the news that conservative Justice Anthony Kennedy is to retire, a huge opportunity has landed in Donald Trump's lap.

Kennedy, 81, has served on the court since 1988. Trump has said the policy is not a Muslim ban, but a necessary safety precaution to be used against countries that don't comply with USA vetting standards.

Challengers have argued the policy is motivated by an enmity they say Trump holds towards Muslims, urging courts to take into account his inflammatory comments during the 2016 presidential campaign.

The Supreme Court judge was joined by his four conservative colleagues in voting along ideological grounds to uphold the order.

Reproductive rights advocates fear that a Supreme Court with five conservative justices will be more likely to uphold such laws if they come before the court.

Chief Justice John Roberts wrote in the majority opinion statement that Trump's government had successfully demonstrated national security reasons for the ban.

And it will only add to the political magnitude of the nomination at a time when Washington seems to zoom from crisis to crisis about trade and tariffs, foreign relations and immigration enforcement.

He also said in an interview with CNN: "I think Islam hates us".

Gorsuch was sworn in in April last year to fill a more than year-long vacancy left by the death of conservative justice Antonin Scalia. Conservative activists have already announced their intention to use a more conservative court to overturn the 1973 Roe v. Wade decision legalizing abortion.
