Indian members of the lesbian, gay, bisexual, transgender (LGBT) community hold placards outside the Supreme Court building in New Delhi as crowds gathered to celebrate the decision to strike down the colonial-era ban on gay sex.

It also said that "consensual carnal intercourse among adults, be it homosexual or heterosexual, in private space, does not in any way harm the public decency or morality".

Although the law was seldom enforced, the gay community said it opened them to harassment and discrimination, and made it impossible for them to seek justice if they were victims of violence, rape or other crimes like blackmail.

Congress chief spokesperson Randeep Surjewala said the age-old colonial law was an anachronism in today's modern times and the verdict restores the fundamental rights and negates discrimination based on sexual orientation. While, in recent times, the law was rarely enforced fully, many members of the LGBT community of India believe that its mere existence helped spread hate, fear and repression of homosexuals.

"History owes the LGBT community an apology for their sufferings", said Justice Indu Malhotra, who was also part of the bench.

The court's ruling struck down the law's sections on consensual gay sex, but let stand segments that deal with such issues as bestiality. "Therefore, Section 377 IPC in its present form violates Article 19 (1)(a) of the Constitution".

The Bench said the courts must protect the dignity of an individual as right to live with dignity is recognised as a fundamental right.

"Constitutional morality can not be martyred at the altar of social morality", Chief Justice Dipak Misra said, reading out the verdict.

While India's law only legalises sexual acts between adults, gay activists have hailed the verdict as a major boost in the deeply conservative country where religious groups have fiercely opposed any liberalisation of sexual morality.

The Supreme Court verdict is being cheered by millions across the country, far beyond the gay community, which has fought for decades for the right to be treated equally.
